A federal or state drug conviction can disqualify a student for federal student assistance. In completing the FAFSA, the student self-certifies that he or she is eligible. Convictions only count against a student if the conviction occurred when the student was receiving federal student assistance. A student regains eligibility the day after the period of ineligibility ends for a first or second offense or when the student successfully completes a qualified drug rehabilitation program that includes two unannounced drug tests by such a program. Students denied eligibility for an indefinite period can regain eligibility after successfully completing a rehabilitation program that includes two unannounced drug tests or have the conviction reversed, set aside, or removed from the student’s record.
